LOS ANGELES/WASHINGTON—Covington represented Expect Fitness in securing approval to participate in the Utah Office of Artificial Intelligence Policy’s healthcare AI sandbox, including negotiating the regulatory mitigation agreement governing its participation. Under the agreement, Expect Fitness will pilot an AI-enabled pelvic floor physical therapy program for women experiencing conditions such as urinary incontinence, pelvic pain, and postpartum pelvic floor disorders.
The pilot is part of Utah’s newly announced healthcare pillar of its Pro-Human AI Initiative, which expands the state’s AI sandbox to support responsible development and deployment of healthcare AI technologies. Utah’s healthcare AI sandbox creates controlled environments for approved participants to gather real-world safety and efficacy data while operating under state oversight. Expect Fitness’s agreement also provides specified regulatory relief related to the pilot, subject to the oversight requirements and other protections set out in the agreement.
Covington advised Expect Fitness on regulatory, healthcare, and artificial intelligence considerations associated with sandbox participation, including engagement with the Office of AI Policy and negotiation of the regulatory mitigation agreement. This representation reflects the firm’s broader work helping healthcare and technology companies navigate emerging regulatory frameworks at the intersection of AI and digital health.
The Covington team included Kristin Davenport, Olivia Dworkin, Jessica Zuo, Anna Kraus, Libbie Canter, Stefanie Doebler, Aubrey Stoddard, Sophie DeBode, and Ahuva Neuberger.
