Merck’s Insurers On the Hook in $1.4 Billion NotPetya Attack, Court Says

Mark Mosier was quoted by The Wall Street Journal in a piece covering Covington’s representation of Merck in the insurance coverage case related to the NotPeyta cyberattack that the U.S. accused Russia of perpetrating. The Court held that the cyberattack did not involve military action and therefore cannot be excluded from coverage under a warlike-act exclusion. Therefore, Merck's insurers must help cover losses.

“The United States didn’t say ‘NotPetya is an act of war against the United States and we’re going to launch a military response,’” Mark said.
