Companies Eager for Rules on Extending NY Child Privacy Rights to Teens

Lindsey Tonsager’s commentary was included in a Lexology PRO article analyzing how companies are responding to New York’s new Stop Addictive Feeds Exploitation (SAFE) for Kids Act and Child Data Protection Act. The SAFE for Kids Act prohibits companies from exposing New Yorkers younger than 18 to online addictive feeds unless they obtain consent. The Child Data Protection Act sets data collection and use restrictions when online services are “primarily directed to minors” younger than 18.

Lindsey provided her insight on how companies are working to comply with the new rules, noting that determining if an online service is primarily directed to minors is “a really hard question when you are talking about teenagers. It’s hard enough for kids under 13” under [the federal Children's Online Privacy Protection Act 1998].

Rulemaking will be critical, Lindsey states, but it’s not too early for companies to start working on their compliance.
