White Collar Defense and Investigations

  • Successful representation of public company in multi-year federal criminal investigation of fraud allegations involving specialty finance business.
  • Represented prominent attorney charged with money laundering, wire fraud and obstruction of justice, obtaining pre-trial dismissal of multiple counts and a landmark decision by the Eleventh Circuit, followed by voluntarily dismissal of the remaining counts.
  • Counsel for public company and top executives in ongoing SEC investigation involving initial public offering.
  • Successful representation of partners of professional services firm in money laundering investigation.
  • Represented former CFO of Adelphia Communications in appeal of criminal convictions for securities and bank fraud, resulting in partial reversal and reduced sentence.
  • Successful representation of CEO of management consulting firm in government investigation involving allegations of fraud in government contracting program.
  • Successful representation of owner of construction firm in criminal investigation involving ransom payments made to the Colombian FARC.

Civil Litigation

  • Successfully defended Schering-Plough in two-month trial in landmark “pay-for-delay” case brought by the FTC challenging settlement of patent infringement cases.
  • Secured dismissal, and Seventh Circuit opinion affirming dismissal, of copyright infringement action against major pharmaceutical joint venture involving use of patient education materials for branded pharmaceutical product.
  • Obtained summary judgment for branded pharmaceutical company of Lanham Act claim brought by generic competitor based on promotional statements consistent with the FDA-approved product label
  • Represented Intel against claims by AMD alleging monopolization of the microprocessor market through alleged loyalty rebates and other conduct.
  • Represented a leading mobile device company in antitrust and breach of contract litigation arising from competitor’s assertion of Standard Essential Patents.
  • Defending government contractor against wrongful death claims arising from mass shooting by employee of a subcontractor. 
  • Defending a major financial institution in action alleging industry-wide conspiracy to rig bids at tax lien auctions.
  • Represented a leading agriculture company in DOJ monopolization investigation involving allegations of “product hopping” and refusal to deal with a competitor.
  • Represented pharmaceutical company in federal securities fraud class action alleging failure to disclose violations of current Good Manufacturing Practices.
  • Obtained summary judgment for Rockwell-Collins of competitor’s antitrust claims alleging it withheld technical information needed to interface with its avionics systems.
  • Represented pharmaceutical and biotech companies in arbitration and mediation of product licensing disputes.
  • Represented the Republic of Uruguay in international arbitration following the failure of Uruguay’s largest private bank.

Pro Bono

  • Led a team of Covington attorneys in successful challenge to Michigan’s practice of denying driver’s licenses to immigrant youth authorized to live and work in the U.S. under the federal Deferred Action for Childhood Arrival’s program.
  • Successful representation of migrant agricultural workers in class action challenging violations of the Fair Labor Standards Act and the Migrant Agricultural Workers Protection Act.
