As a litigator in Covington’s Washington office, Laura Flahive Wu handles an array of commercial disputes and class actions across a variety of industries, including sports, media, internet, technology and financial services. She has significant experience representing clients in complex contractual disputes, cable carriage complaints, and securities litigation.

Sports

  • Representation of the NFL in connection with insurance coverage for concussion-related claims.
  • Representation of the NFL in a program carriage hearing before the Federal Communications Commission concerning distribution of the NFL Network.

Media, Internet, and Technology

  • Successfully represented a group of content companies challenging an order of the Federal Communications Commission that would have resulted in the release of their confidential trade secrets to third parties. The D.C. Circuit first agreed to stay enforcement of the FCC’s order, and then overturned the order on both substantive and procedural grounds.
  • Representation of Cox Media Group LLC in contractual indemnification action arising from allegations that the Company misrepresented expenditures for a television asset.
  • Representation of a major record company in contractual disputes with artist over royalties on new forms of music distribution.
  • Representation of multiple MVPDs in connection with possible arbitrations to determine the terms and conditions for the carriage of Comcast-NBCUniversal video programming pursuant to the Comcast-NBCUniversal Merger Order.

Financial Services and Securities

  • Representation of a major energy company in a securities action arising from allegations that the Company overstated the expected returns from its gas wells.
  • Representation of targets and acquirers and their officers and directors in merger litigation, including shareholder litigation arising from the acquisition of:
    • Atlas Pipeline Partners, L.P. (representation of the Special Committee of the target);
    • Clinical Data (representation of acquirer Forest Laboratories);
    • Del Monte Corporation (representation of the target); and
    • Arena Resources, Inc. (representation of acquirer SandRidge Energy).

Pro Bono

  • Advise a leading international anti-corruption organization on newsgathering and prepublication review issues.
  • Represent plaintiffs in putative class action regarding police department’s stop, question and frisk policies and procedures, which violate the Fourth Amendment and the Equal Protection Clause of the Fourteenth Amendment.
