U.S. Government Releases Awaited “Section 889” Rule on Prohibition on “Use” of Covered Telecommunications Equipment by Federal Contractors

On July 10, 2020, the U.S. Government's Federal Acquisition Regulatory Council (“FAR Council”) released a prepublication version of the interim rule governing Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. No. 115-232), and added some clarifications to definitions that impact Section 889(a)(1)(A), which went into effect in August 2019.
