Today’s legal landscape features a diverse and evolving set of government-facing certification and attestation requirements, arising in contexts ranging from cybersecurity and privacy-related regulatory submissions, government contracting, antitrust filings, financial reporting, foreign data transfer activity, and more. While the subject matter and specifics can vary, companies subject to these types of requirements often question how best to prepare certifications and attestations with an eye toward protecting themselves (and their signatories) from enforcement risk.
