DOJ's New FCPA Enforcement Guidelines and What They Mean for Companies in the Middle East and Africa

On June 10, 2025, the U.S. Department of Justice issued new Guidelines for Investigations and Enforcement of the Foreign Corrupt Practices Act, ending the “FCPA Pause” put in place by President Trump in February 2025. These new FCPA Guidelines are notable in several respects, including their prioritization of enforcement actions involving conduct that “resulted in economic injury to specific and identifiable American companies or individuals.” 

On 7 July, 2025, Jennifer Saperstein (Co-Chair of Covington & Burling LLP’s Anti-Corruption Practice Group) and Ben Haley (leader of Covington’s White Collar and Anti-Corruption Practice in Africa and the Middle East) will co-host a webinar on the new FCPA Guidelines with the Middle East and Africa Compliance Association (“MEACA”). Among the topics covered will be:

• With their emphasis on cases that involve economic injury to American interests, do the Guidelines mean an increased enforcement focus on non-U.S. companies? 
• How do the Guidelines overlap with DOJ’s focus on cases involving Foreign Terrorist Organizations?
• Do the Guidelines affect how companies should approach investments or market entry in high-risk markets?    
• Should companies be considering changes to their compliance programs as a result of the Guidelines?
