Patrick Phelan is a litigator whose practice focuses on white collar defense and investigations and intellectual property litigation.  Mr. Phelan has extensive experience representing major companies in civil and criminal investigations by the Department of Justice and other federal agencies concerning allegations of off-label promotion and violations of the False Claims Act and Anti-Kickback Statute.  He has participated in all aspects of case development and strategy and is an expert on eDiscovery issues.  Mr. Phelan also has significant civil litigation experience through his representation of clients in trademark disputes before federal courts and arbitration forums.

  • Counsel to a major pharmaceutical company in an investigation by the Department of Justice concerning alleged violations of the False Claims Act.
  • Counsel to a major pharmaceutical company in an investigation by the Department of Justice concerning alleged violations of the Food, Drug, and Cosmetic Act.

Intellectual Property

  • Counsel to The American Automobile Association, Inc. in trademark and unfair competition litigation and domain name disputes before U.S. District Courts, National Arbitration Forum, and World Intellectual Property Organization.
  • Counsel to a variety of clients in enforcement of Intellectual Property rights in connection with Internet-related activities (e.g., domain name cybersquatting and trademark infringement).
  • Represented a major pharmaceutical company in trademark and unfair competition litigation in federal court.

Pro Bono

  • Represented deaf individuals in federal civil rights litigation against hospital that failed to provide effective communication during medical emergency.
  • Counsel in ยง 1983 action against police and prosecutors in Washington Parish, Louisiana arising out of wrongful conviction and Brady violations.
