    Nicole Pobre is an intellectual property litigator with experience representing clients across patent, copyright, and trademark matters across a diverse range of industries.

    Nicole has litigated cases on behalf of clients in the medical device, wireless technology and telecommunications, consumer electronics, alcoholic beverage, and food industries. She has also represented clients in contract disputes and advised on IP licensing. Nicole has successfully litigated in various U.S. district courts, as well as before the Patent Trial and Appeal Board (PTAB) and the U.S. Court of Appeals for the Federal Circuit.

    Prior to law school, Nicole worked as a patent examiner at the U.S. Patent and Trademark Office, where she examined patent applications in the areas of electrosurgery, medical devices, and thermal therapies.

    • Bureau National Interprofessionnel du Cognac, Institut National des Appellations d'Origine v. Cologne & Cognac Entertainment (CAFC): Represented BNIC and INAO in appeal at U.S. Court of Appeals for the Federal Circuit regarding the COGNAC certification mark of regional origin resulting from opposition proceeding at TTAB. Successfully obtained vacatur and remand to TTAB for claims of likelihood of confusion and dilution for common law certification mark COGNAC in decision setting precedential law on scope of protection for certification marks.
    • Carbyne Biometrics v. A Major Multinational Consumer Electronics Company (WDTX): Defended a major multinational consumer electronics company in a six-patent suit concerning authentication and fraud reduction. The Court found all pending claims subject matter ineligible following dispositive motion practice.
    • XpandOrtho/Exactech v. A Global Medical Technology Company (S.D. Cal., MDFL, PTAB): Represented Exactech and XpandOrtho in a multi-district litigation involving patent, copyright, and trade secret issues regarding orthopedic surgery tools, including filing multiple IPRs successfully instituted at the PTAB, reaching a highly favorable settlement.
    • Collision Communications, Inc. v. A Major Telecommunications Company; Collision Communications, Inc. v. Telefonaktiebolaget LM Ericsson et al. (EDTX): Represented Collision Communications in two cases in the Eastern District of Texas involving infringement of multiple 3G and 4G/LTE patents by the defendants’ cellular infrastructure products and services, obtaining highly favorable settlements for Collision on the eve of trial.
    • Collision Communications, Inc. v. A Major Telecommunications Company (DNH): Represented Collision in breach of contract case in the District of New Hampshire. After a two-week trial, the jury found for Collision on all counts and awarded $23 million in damages.
    • Teleputers, LLC v. A Leading Semiconductor Company, Inc. et al. (W.D. Tex.): Represented a leading semiconductor company in a two-patent litigation concerning permutation algorithms implemented on ARM processors. Persuaded Judge Albright to flip a tentative ruling and find all apparatus claims of an asserted patent indefinite.
    • Represented client on enforcement of its food-product certification mark and methods for improving the strength of that mark in the United States.
    • Represented a global technology company in an opposition appeal before the European Patent Office Board of Appeals.
    • Advised The Vistria Group on intellectual property and licensing matters relating to a series of healthcare-related acquisitions.
    • Advised a private equity fund on intellectual property and licensing matters relating to acquisition of a pharmaceutical company.
