  • Representation of Merck & Co., Inc. and Roche Palo Alto LLC in patent litigation in the District of New Jersey against Sun Pharmaceutical Industries, Ltd. relating to Ganirelix Acetate Injection, which is one of the drugs used in women undergoing in vitro fertilization.
  • Representation of UCB in Hatch-Waxman litigation filed against 16 generic companies in the District of Delaware involving UCB’s Vimpat® product, used in the treatment of epilepsy and other CNS disorders.
  • Representation of AstraZeneca in Hatch-Waxman patent litigation against Barr and Mylan concerning Entocort® EC, used for the treatment of Crohn’s disease.  AstraZeneca LP v. Mylan Pharmaceuticals, Inc (D. Del.).
  • Representation of Bristol-Myers Squibb in patent litigation in the District of New Jersey against Dr. Reddy’s Laboratories relating to IXEMPRA® Kit, an intravenous infusion treatment for metastatic or locally advanced breast cancer after failure of at least an anthracycline and a taxane.  Bristol-Myers Squibb Company v. Dr. Reddy’s Laboratories Ltd., et al. (D.N.J.).
  • Representation of Merck before the International Trade Commission, as well as parallel district court litigation. Due to our efforts, the Complainant/Plaintiff dismissed its complaint in the ITC, as well as in the Eastern District of Virginia.  In re Certain Vaginal Ring Birth Control Devices (USITC) and Femina Pharma Inc. v. Merck & Co., Inc., et al. (E.D. Va.).
  • Representation of Auxilium Pharmaceuticals in a Hatch-Waxman case involving transdermal testosterone gel for treatment of male hypogonadism . Auxilium Pharmaceuticals, Inc. and Cpex Pharmaceuticals, Inc. v. Upsher-Smith Laboratories, Inc. (D. Del.).
  • Representation of GlaxoSmithKline in patent litigation brought by Classen Immunotherapies involving immunization methods and schedules.  Classen Immunotherapies, Inc. v. Biogen IDEC, et al. (D. Md.).
  • Representation of Ortho-McNeil in:
    • the District of New Jersey in an ANDA case brought against Lupin involving Ortho Tri-Cyclen® Lo.  Following a bench trial, the judge ruled in favor of our client, declaring the patent valid, blocking Lupin’s effort to market a generic competitor.  Janssen Pharms Inc. v. Lupin Pharms , Inc. et al. (D.N.J.);
    • the District of New Jersey in an ANDA case brought against Barr relating to a patent covering Ortho Tri-Cyclen ® Lo, an oral contraceptive.  Trial was adjourned when settlement discussions began the first day of trial.  When settlement did not materialize, we moved for a preliminary injunction and a recall of the infringing product, which had already been sent to distributors and pharmacies, and it was granted.  We subsequently obtained a highly favorable settlement for our client.  Ortho McNeil Pharmaceutical, Inc. v. Barr Laboratories, Inc. (D.N.J. 2009); and
    • the Northern District of West Virginia and the Court of Appeals for the Federal Circuit in an ANDA case brought by Mylan Laboratories relating to a patent covering Levaquin®, an antibiotic. Ortho-McNeil prevailed in the district court, and the decision was affirmed per curium by the Federal Circuit. Ortho-McNeil Pharmaceuticals, Inc. v. Mylan Laboratories, Inc. (N.D.W. Va.).
  • Representation of Sanofi in Hatch-Waxman litigations against Accord Healthcare, Sandoz, and Sun Pharmaceuticals concerning Sanofi's Taxotere® cancer treatment.  sanofi-aventis v. Accord Healthcare, sanofi-aventis v. Sandoz, sanofi-aventis v. Sun Pharmaceuticals (D. Del.).
  • Representation of Shire in the District of New Jersey and the Southern District of Florida in an ANDA case brought against Andrx and Watson concerning Shire’s ADDERALL XR® product for the treatment of ADHD.  Shire Laboratories Inc v.
