Chris Pistilli’s practice focuses on the defense of class actions and other complex civil matters.  He has substantial experience with high stakes ERISA litigation, having represented pension plans, plan sponsors and plan fiduciaries in the trial courts and on appeal.  Mr. Pistilli was recently recognized by Legal 500 as an “experienced litigator who combines his litigation skill with knowledge of ERISA law.”  He also regularly represents the financial services industry in civil litigation matters, including the defense of class and collective action claims brought on behalf of consumers.

  • Represent leading financial institution in parens patriae lawsuits filed by state attorneys general alleging unfair and deceptive practices involving credit card “add-on” plans.
  • Successfully represented American Bankers Association in challenge to Volcker Rule provision of Dodd-Frank Act brought in federal district court and D.C. Circuit.
  • Successfully represented Verizon Communications in ERISA litigation challenging its transfer of $7.5 billion in pension liabilities to The Prudential Insurance Company of America.
  • Persuaded the U.S. Supreme Court to grant review and reverse a Second Circuit ruling against the Xerox pension plan in a case that made new law under ERISA. See Conkright v. Frommert, 130 S. Ct. 1640 (2010).
  • Represented national bank in putative class action alleging violations of state consumer protection statutes.
