Philip Norman

Partner

Philip Norman has been in practice for nearly 25 years, first as a barrister in independent practice and then as a partner in a firm specializing in international arbitration and dispute resolution. He has significant experience in mediation, expert determination and adjudication and extensive experience advising on matters in the construction, engineering, infrastructure, project finance, energy, oil and gas, and power sectors, as well as TMT infrastructure. Mr. Norman also sits as an arbitrator.

Mr. Norman’s practice extends across many jurisdictions, including Saudi Arabia, UAE, Egypt, Turkey, Iraq, Qatar, UK, Ireland, Italy, Greece, Spain, France, Romania, Russia, Nigeria, Kenya, Uganda, South Africa, Japan, Hong Kong, Vietnam, and Singapore. In addition, he has spent time in-house with Black & Veatch in the UK, acting as general counsel for the EMEA region.

Construction and Energy

  • Italy and Greece – ICC Arbitration in relation to construction of an orbital highway in the Middle East.
  • Iraq and USA – LCIA Arbitration in connection with the supply, maintenance and operation of turbines in a power production plant.
  • Kenya – Ad Hoc arbitration enforcement proceedings through the DIFC Courts.
  • Japan and Saudi Arabia – ICC Arbitration relating to the design and construction of an aromatic unit in a multi-chemical production facility in Saudi Arabia.
  • South Korea – Acting for a major heavy industry constructor which was contracted to engineer, procure, construct, deliver, install, and commission a floating dock to accommodate Q-Max LNG vessels. Claims related to payments, contractual variations and extensions of time.
  • Miami, Florida – AAA arbitration relating to the construction of the U.S. Air Force Base situated in the Middle East. Claims for termination, bond calls, and delay and disruption.
  • Dubai – Arbitration relating to claims for delay, disruption, and variations from a subcontractor on the Passenger Terminal at the Dubai Airport.
  • Middle East – Two separate arbitrations (for different clients) in relation to an international airport and claims for extensions of time, variations, and disruption on different work packages.
  • UAE – ICC arbitration, London Commercial Court, Courts of Sharjah: Advising in relation to disputes on the construction of a cement production plant, force majeure issues (power connection) and losses arising from delays. Enforcement action included making injunctive relief applications in London and Sharjah.
  • Turkey – Two ICC arbitrations international arbitrations: Advising and representing main contractor in relation to complex BTC pipeline pumping (compressor) station and pipeline fixing disputes.
  • South Africa – Advising on the dispute resolution provisions of a Concession Agreement on Gautrain.
  • UK – Advising the employer in relation to London’s Wembley Stadium including risks and contractual matters as well as advising and representing on claims from and against the Main Contractor (TCC, High Court, London).
  • Nigeria – Advising the owner in connection with civil engineering issues/subcontracts and time claims arising from construction of a cement plant.
  • South Africa – Arbitration relating to Aluminum Smelting Plant, advising in relation to suspension of works and force majeure.

Commercial Litigation and Arbitration

  • UAE – Advising and representing a manufacturer of nets which is resisting a claim for non-fulfilment of a sale and purchase agreement for chemicals used for the insecticidal treatment of mosquito nets and which has a counterclaim against the chemical supplier for inadequate quality product.
  • Iraq, UK, and Dubai – Claims for misstatement, misrepresentation, and breaches of an investment contract for the development of a power plant. In addition claims in negligence were made against professional advisors and with claims for breaches of trust in the manner solicitor’s clients’ accounts were being operated (Commercial Court, London; DIFC Court and DIFC seated arbitration).
  • Korea and France – Advising a member of a JV that was purchasing an LNG vessel. The contractor was not performing its obligations, but there was a disagreement between our client and its JV partner as to how to proceed against the contractor.
  • Vietnam – Advising and representing owner/government in four ICC arbitrations relating to the Ho Chi Minh East-West Highway and payment calculation methods to correct for currency fluctuations, increases in cost of materials and sourcing of materials from different countries.
  • Russia, Italy, and France – TCC, London: Advising and representing major French main contractor in relation to bond calls made in connection with a project in Sakhalin Island.
  • UK - International arbitration against major investment bank in connection with Put Options and Collateralized Loan Agreements.


Media, Internet, and Technology

  • Advising a telecom network provider in relation to complaints to the country’s regulator about pricing to access communication infrastructure and anti-competitive behavior of a Middle Eastern state telecoms company.
  • Advising and representing a bank in arbitration in connection with its acquisition, modification, installation, testing, and training of new trading software.
  • Middle East – Advising a company operating throughout the Middle East on failures in providing, modifying, and installing an ERP software packages.
  • Advising a television AV equipment provider on its payment claims relating to the leasing of equipment and its maintenance and operation to a major local television channel.
  • Turkey, Switzerland, and Germany – Computer Company Shareholder’s dispute: ICC arbitration in relation to guarantees given during the sale of shares and transfer of business relating to defense and healthcare computer software and systems
