    Megan Keane is a litigator, with over a decade of experience, whose practice focuses on representing life sciences clients in high-stakes patent litigation and other intellectual property matters.

    Megan has taken a leading role in successfully representing clients on complex matters from case inception through trial and appeal. She is an experienced trial litigator and has handled complex witness examinations and oral arguments, including in some of the national’s leading patent jurisdictions. Megan specializes in matters concerning small molecules, biologics, and medical devices.

    Megan has represented clients in a range of intellectual property matters, including:

    • Hatch-Waxman patent litigation
    • BPCIA patent litigation
    • Litigation concerning allegations of trade secret misappropriation
    • Inter partes review proceedings before the Patent Trial and Appeals Board
    • Appeals to the Federal Circuit

    Megan has a strong track record of achieving successful results for her claims at all stages of litigation. These successful outcomes include a recent trial victory in a Hatch-Waxman patent litigation, a complete rejection of trade secret misappropriation claims, and a complete victory in an IPR before the PTAB and the Federal Circuit.

  • Representative Matters
    • Represented AstraZeneca in successfully asserting multiple patents against two generic companies who sought to market generic versions of AstraZeneca’s Symbicort® product prior to expiration of the patents. Following a remote trial that took place in October 2020, the district court judge found in favor of AstraZeneca on all issues.
    • Obtained a complete defense victory for a leading pharmaceutical company against plaintiff’s trade secret and breach of contract claims totaling more than $1.8 billion and successfully represented the same company in confirming inventorship of patents relating to the relevant technology.
    • Represented Bristol-Myers Squibb in an IPR proceeding, resulting in a decision upholding the patentability of all claims. On appeal, we argued that the patent challenger’s appeal should be dismissed for lack of standing and, in a precedential opinion, the Federal Circuit agreed.
    • Represented a leading pharmaceutical company in BPCIA patent litigation, concerning a biologic product indicated to treat cancer.
    • Represented Eli Lilly and Company, Imclone LLC, and Bristol-Myers Squibb Company in an IPR proceeding related to Erbitux®, a monoclonal antibody used in the treatment of various cancers.
    • Represented AstraZeneca in Hatch-Waxman patent litigation against more than ten generic challengers regarding Nexium® and Nexium® 24Hr.

    • Represented of Warner Chilcott in multiple Hatch-Waxman patent litigation matters successfully defending its Asacol® product from generic challengers.
    • Represented multiple major pharmaceutical companies in Hatch-Waxman litigation relating to oral contraceptive products, resulting in favorable decisions at multiple trials.
    • Represented Amarin in Hatch-Waxman patent litigation concerning Vascepa®.
    • Represented a medical device company in a patent litigation case concerning soft tissue matrices.
    • Represented a vitamin company in patent litigation in the District of Delaware, resulting in a favorable result for the client.
    • Represented a digital analytics company in two patent infringement cases in the Eastern District of Virginia.
    • Represented a semiconductor manufacturer in a Section 337 investigation.
