Tom Cusworth is a litigator with particular expertise in jurisdictional, immunity and conflict of law issues. He focuses on complex commercial and contractual disputes, and has represented clients in the English High Court, the Court of Justice of the European Union and before arbitral tribunals under LCIA and ICC rules. Mr. Cusworth has experience advising financial services firms, corporates and individual clients on high-value disputes, on international asset-tracing and enforcement and on the legal implications of Brexit.

  • Advising a private investment firm in relation to a professional negligence claim against a major accounting and professional services firm.
  • Representing a multilateral development bank and an EU institution in the English High Court and the General Court in claims against a sovereign state for outstanding amounts under a series of loan agreements and related guarantee arrangements.
  • Acting for an individual in a LCIA arbitration relating to a shareholder dispute.
  • Representing a global investment bank in enforcement proceedings in ten jurisdictions involving the enforcement of a judgment made in the context of a family trusts dispute.
  • Advising a consortium of investment banks on immunity and disputes issues on a large derivative transaction with a sovereign state, where a multilateral development bank was providing its first ever guarantee in the context of such a transaction.
  • Acting for a major energy company in an ICC arbitration in relation to the abandoned construction of a gas pipeline across the Black Sea.
  • Advising a European international financial institution on the implications of Brexit.
  • Representing an investment bank in the English High Court on claims brought against it for damages for alleged loss in relation to the execution of certain trades on the London Metal Exchange.

  • Assisted numerous individuals with applications for registration as British citizens.
  • Represented individuals on their appeals before the First-tier Tribunal (Social Security and Child Support).
