    Tom Cusworth is a litigator with particular expertise in jurisdictional, immunity and conflict of law issues. Tom has experience advising corporates in the energy, life sciences, consultancy and financial services sectors, as well as individual clients on high-value disputes, on international asset-tracing and enforcement of foreign awards and judgments in the UK. He focuses on complex commercial and contractual disputes, and has represented clients in the English High Court, the Court of Justice of the European Union and before arbitral tribunals under LCIA, ICC and SCC rules.

    • Representing a global management consultancy firm on a judicial review claim against the UK Government challenging a procurement-related decision made against the firm and defending against a related claim.
    • Defending an ultra-high-net-worth individual from civil and criminal claims in a set of shareholder disputes worth over $300m, involving allegations of conspiracy, fraud and unfair prejudice across multiple jurisdictions.
    • Acting for a European pharmaceutical and biotechnology firm in relation to licensing and development issues with its licensees in the US and Asia.
    • Providing advice to a leading COVID-19 vaccine manufacturer on a potential $1bn dispute relating to unpaid invoices.
    • Defending an Ukrainian energy sector client against debt and related claims brought by Russian energy and financial institutions in the context of an English restructuring.
    • Bringing claims on behalf of a multilateral development bank and an EU institution in the English High Court and the General Court against a sovereign state for outstanding amounts under a series of loan agreements and related guarantee arrangements.
    • Representing a global investment bank in enforcement proceedings in ten jurisdictions involving the enforcement of a $150m judgment made in the context of a family trusts dispute.
