Erica Andersen focuses on intellectual property litigation and Hatch-Waxman advisory work. She has experience managing complex, multi-party litigations from complaint to trial and through appeal. Ms. Andersen, a vice-chair of the firm's Patent Litigation Practice Group, has significant trial experience, including ten trials since 2014. She has argued at discovery, claim construction, and pre-trial hearings and conferences, as well as conducted opening statements and direct and cross examinations at trial.

From 2008 to 2009, Ms. Andersen served as a law clerk for the Honorable Alvin A. Schall of the United States Court of Appeals for the Federal Circuit.

  • Secured a major bench trial victory for Indivior in a bet-the-company patent litigation dispute relating to the company’s billion dollar Suboxone® Film product. 
  • Representation of Shire LLC in a series of Hatch-Waxman cases in the Southern District of New York, the Northern District of Texas, the District of Massachusetts, and the District of New Jersey, concerning Shire’s Adderall XR® product for the treatment of ADHD. Secured major bench trial victory, including sanctions against Abhai, LLC, the generic filer, in the only Adderall XR® patent litigation that proceeded to final judgment.
  • Represented Purdue Pharma L.P. and Transcept Pharmaceuticals at trial and appeal in a Hatch-Waxman patent litigation against several generic drug companies. The case involved Intermezzo®, a drug for the treatment of insomnia.
  • Represented Warner Chilcott in a trial and appeal involving Generess®, a chewable oral contraceptive product.
  • Representation of Auxilium Pharmaceuticals in the District of Delaware and the District of New Jersey, involving transdermal testosterone gel for treatment of male hypogonadism.
  • Successfully represented Microsoft on appeal at the Federal Circuit, defending summary judgment of non-infringement in a patent case relating to messaging technology.
  • Represented comScore, Inc. in the Eastern District of Virginia in simultaneous patent infringement actions involving digital analytics.
  • Representation of a vitamin and nutritional supplement company in a patent litigation in the District of Delaware, yielding a favorable result for the client.
  • Representation of a major pharmaceutical company in D.D.C. in a dispute with the U.S. Patent and Trademark Office over the proper amount of patent term adjustment, ending in a favorable result for the client.

  • Successful representation of a veteran in a challenge to a benefits determination.
