SCOTUS Poised To Upend Limits On Presidential Control Of Agencies

Kevin King was quoted in an Inside Health Policy article about the Supreme Court’s apparent readiness to overturn longstanding limits on presidential authority over independent regulatory agencies, a shift that could significantly expand White House influence over the FTC and other health related bodies.

Kevin noted that while the case will not directly affect FDA or HHS, the decision could still shape FDA’s collaborations with independent agencies and influence interagency dynamics when administrations change.

Kevin said, “President Trump has sought to root out that conflict where he had essentially Biden appointees running important federal agencies during his term. He wanted federal agencies to reflect his policies and the policies his voters asked for when they elected him. So, I think that's the most prominent situation in which Slaughter is likely to matter.”
