Supreme Court grapples with lawsuit challenging mail-in ballot rules

The Washington Post featured Matt Shapanka’s commentary on a case before the Supreme Court about whether to allow Illinois congressman Michael Bost, and others, to go forward with a lawsuit challenging the state’s policy of counting mail-in ballots that arrive after Election Day.

The question before the justices Wednesday was a narrow one — whether Bost had met the basic legal threshold to bring his lawsuit, otherwise called standing — not the legality of the Illinois law, which allows the state to count ballots that arrive up to 14 days after the polls close as long as they are postmarked by Election Day.

“It’s tough to see where they’ll actually go,” Matt said. “There was disagreement about the breadth of what candidate standing would look like.”
