Companies Eager for Rules on Extending NY Child Privacy Rights to Teens

Lindsey Tonsager’s commentary was included in a Lexology PRO article on

New York’s enactment of the Stop Addictive Feeds Exploitation for Kids Act and the Child Data Protection Act. This legislation joined a growing state and federal push to extend the federal Children's Online Privacy Protection Act’s consent requirement beyond 13 year-olds, and set new data protections for minors up to the age of 18.

Lindsey noted that determining if an online service is primarily directed to minors is “a really hard question when you are talking about teenagers. It’s hard enough for kids under 13” under COPPA. She notes that rulemaking will be critical, but it’s not too early for companies to start working on their compliance.
