Chevron's Demise Could Stall FDA Rulemaking, Former Officials Say

Jerry Masoudi’s commentary was included in a Politico article examining how the U.S. Supreme Court’s decision to overturn the Chevron doctrine could slow down the development of new drugs and medical devices as a result of greater litigation against the Food and Drug Administration (FDA).

Jerry provides his insight on how FDA processes can be shored up post-Chevron, saying that “the agency is really going to have to build in a lot more explanation of why it comes to the decisions that it does. Instead of showing it’s being reasonable, it will have to write a decision that has the power to persuade a court that it’s right.”
