California High Court Strikes Anti-Tax Measure From November Ballot

David Goodwin’s commentary was included in a Law360 article covering a California Supreme Court ruling that removed a ballot initiative that would make it more difficult to raise taxes in California because it would revise the state constitution and cannot be enacted by citizen initiative. Rather, the power of taxation is reserved for elected officials.

David co-authored an amicus brief on behalf of former Governor Jerry Brown in support of removing the initiative and noted that “what happened was about halfway through the hearing Justice Liu took over the questioning and started asking about the [state] agencies, how this would affect the government, and the whole tenor of the hearing changed.”
