Wary Justices Have Many Off-Ramps in Trump Ballot Dispute

Matt Shapanka’s commentary was included in a Law360 article looking ahead to the U.S. Supreme Court’s review of former President Donald Trump's disqualification from Colorado's 2024 primary ballot. The article also covers how the court might try to narrowly rule on the matter without commenting on Trump's ability to hold office.

Matt gave his insight on the court’s decision, saying, "That they would take the case comes as no surprise. How they choose to decide it will be.” He added that “it makes sense that the court would want to resolve the split before either party has a nominee. It's [not] a surprise that the court wants to at least weigh in before the primaries wind down.”

Matt also commented on how “the justices are well aware of the time pressures involved with Trump's case, and that's likely why they scheduled a special February 8th oral argument session in the case just days before Super Tuesday. But the Supreme Court runs on its own timeline and won't issue a ruling before it's ready to.”
