CMS Issues Guidance For Medicare Drug Inflation Rebates

Anna Kraus’s commentary was included in a Law360 article discussing new guidance by the U.S. Centers for Medicare and Medicaid (CMS) that addresses how its Medicare prescription drug inflation rebate program calculates rebates for drug shortages. CMS also announced that 48 drugs are subject to the pricing rebates.

Anna gave her insight to what the new guidance means in practice, saying, “In this revised guidance, CMS attempts to clarify how and when it will modify the rebate amount in certain scenarios, including drug shortages, supply chain disruptions, and with respect to certain generic or biosimilar products.”
