Importers Still In The Dark On Forced Labor Law Compliance

Tom Plotkin’s commentary was included in a Law360 article on the lack of clear standards around how importers will be in compliance with the Uyghur Forced Labor Prevention Act (UFLPA). The article further details that without specific requirements for clearing UFLPA applicability reviews, trade groups and individual companies have largely been left with trial-and-error as they develop supply chain traceability protocols to satisfy U.S. Customs and Border Protection (CBP).

"Obviously that makes it very difficult to produce evidence and documentation to CBP either trying to show that they are mistaken about the supply chains or that the goods [from those supply chains] were not produced with forced labor," Tom said of the current ambiguity around enforcement standards.
