$1.3 Billion India Award Case Could Snag Justices' Attention

Megan Crowley contributed her expertise to a Law360 article covering the potential for the U.S. Supreme Court to take up a case regarding the enforcement of a $1.3 billion arbitral award against an Indian state-owned entity. The article details how the Ninth Circuit originally ruled that a U.S. District Judge wrongly enforced the billion-dollar award issued to Devas Multimedia Pvt. Ltd., an Indian satellite communications company.

“There's no doubt that the Ninth Circuit is an outlier on this question," Megan said. She added that the Supreme Court has never squarely decided on whether foreign states can be considered "persons" under the due process clause in the Fifth Amendment.
