EU Officials Claim Third Pass at New Data Deal Is Legally Sound, but Privacy Advocates Disagree

Daniel Cooper’s commentary was included in a Law.com article detailing a new agreement adopted by the European Commission which allows companies to resume the transfer of users’ personal data across the Atlantic without needing to put in place special safeguards to keep that data safe.

Daniel stated that EU and U.S. officials clearly took pains to ensure the new deal would be better equipped than its predecessor to survive a future legal challenge.

“The framework reflects some serious commitment from the U.S. side in terms of limiting government access to data and providing legal redress,” he said. “That said, there will be those who assert that things should have been taken further. But that was always going to be the case.”

EU officials will periodically review whether the new U.S. safeguards are “functioning effectively in practice,” with the first review planned for July 2024.
