Corporations On Edge After High Courts Jurisdiction Ruling

Kevin King’s commentary was included in a Law360 article on the recent U.S. Supreme Court decision, Mallory v. Norfolk S. Railway Co., which upheld a Pennsylvania state law that says companies registered in Pennsylvania can be sued in its state courts, regardless of what ties, if any, the specific claim has to the state.

Kevin said, "At a high level, this decision means more uncertainty for businesses and defendants in lawsuits like this one.”

With the uncertainty, Kevin expects that follow-on litigation will center on the extent of a company’s business in a state, which “clearly mattered” to the plurality justices. This will be a key point on which battle lines between the defense and plaintiffs bars are drawn in follow-on litigation.
