Belgium levels final accusations in first hybrid settlement case

Global Competition Review included Johan Ysewyn's commentary about Belgium’s Competition Authority formally levying cartel allegations against the only wholesale distributor of pharmaceutical products that did not settle in the enforcer’s first-ever hybrid settlement case.

The authority said that its prosecution service submitted its findings to the agency’s Competition College, alleging that the Centre Européen de Répartition Pharmaceutique (CERP) was one of three distributors involved in two separate cartels that fixed commercial conditions for bulk orders and influenza vaccines for 13 years.

Johan said it is very rare for a cartel case to go before the Competition College, as they are usually settled at an earlier stage before the Prosecution Service.
