Policyholder Gains In Virus Coverage State Trial Court Suits

Rani Gupta spoke with Law360 recently regarding the current and future state of COVID-19 coverage cases. She noted that a recent ruling in Iowa was narrowly tailored on the government orders claim. It "left open the door" for a potential better outcome in cases that allege the virus on the premises.

"The recent rulings show that there are strong cases," Rani said. "It will be interesting to see if the appellate courts look at these cases in progress and take a different position from the rulings to date."

She added that there are more promising cases still in their early stages that haven't been heard on the state high court level yet. In light of recent rulings, she is hopeful that courts will hold that the disputes deserve to make it past the dismissal stage, where a majority of them have previously died out in federal courts.
