Lindsey Tonsager spoke with Global Data Review regarding President Joe Biden's State of the Union address calling for more protection for children online against targeted advertising and data collection. Lindsey observed, “One of the things that’s going to be interesting to watch as this topic gets more attention is how these – really important – children’s privacy and safety concerns are balanced against those constitutional issues that have tripped up similar laws in the past.”
In regards to existing and future potential legislation around children's data privacy, Lindsey added, “I do think that it’s quite possible that there could end up being a mismatch between the requirements. For example, whatever requirements the Californian taskforce enacts could be quite different from the requirements at the federal level."
She concluded, “Biden’s support makes it more likely that it [new legislation] could pass, but the timing issue is the unknown."
