David Fagan is quoted in a Commercial Dispute Resolution article regarding how companies are bracing for cyber attacks. According to Fagan, cybersecurity is “a one-way ratchet: all constituents, whether customers, regulators, business partners, claimant counsel and finders of fact, are increasingly aware of and focused on the risk [which] arises from operating in a digitally interconnected world." As more systems, assets, products, and services become reliant upon those digital interconnections, “the more imperative it becomes to manage that risk." He adds, “In turn, we have seen, and will continue to see, cybersecurity grow as an issue across a range of legal areas – regulatory and advisory practices focused on incident response; insurance coverage and litigation; securities law and government contracting; IP protection and product liability litigation; M&A due diligence to licensing and vendor transactions; and even employment law.”
