Two Former Patent Trial Board Judges Join Covington & Burling

Peter Chen is quoted in a Daily Journal article regarding his arrival to the firm’s Patent Office Trials Practice.

Chen says his experience on the bench will enable him to give clients a unique insider perspective. “I was privileged to preside over these [America Invents Act] trials and to have participated in the PTAB management.”

Chen adds that he expects to see the number of case filed with the board increase in the future, especially post-grant review proceedings, which only apply to patents filed after 2012. “There are potentially more bases [in post grant reviews] for a challenger to raise a challenge” on subject matter eligibility.
