Litigator of the Week Runners Up and Shout Outs: Covington Recognized for Joint Defense Win in Baby Food MDL

A Covington team earned a Litigator of the Week runner‑up mention in AmLaw Litigation Daily as part of a joint defense group representing baby food manufacturers in multidistrict litigation alleging that lead and arsenic in baby food products cause autism spectrum disorder and ADHD.

Following a four‑day Daubert hearing, U.S. District Judge Jacqueline Scott Corley excluded plaintiffs’ general causation and exposure experts, finding their opinions unreliable and unsupported by scientific evidence. The court concluded that plaintiffs failed to identify studies showing that baby food can cause ASD or ADHD and rejected the proposed causation theory as speculative.

Covington represented Hain in the matter. The Covington team included Phyllis Jones, who examined one of the plaintiffs’ experts, along with Michael Imbroscio and Elizabeth Fouhey.
