Melody Wu practices in the area of intellectual property, with a focus on patent law. She directs the strategy for worldwide patent portfolios covering several major pharmaceutical products and candidates. Ms. Wu acts as a special consultant regarding patent and patent office issues in contexts such as pre-litigation case assessment, due diligence for transactions, inter partes review, and patent litigation. She has experience with a range of technical subject matter including biofuels, vaccines, speech synthesis, cognitive training software, gene expression, and RF shielding.

  • Advising on IP issues concerning the production and packaging of wines and other beverages.
  • Drafting a patent application on monitoring the expression and activity of complex plasma membrane proteins using novel fusion proteins.
  • Advising on patent term adjustment and term extension regimes in connection with Transatlantic Trade and Investment Partnership negotiations.
  • Developing the strategy resulting in accelerated grant of four new patents eligible for listing in the Orange Book, in coordination with parallel inter partes review proceedings.
  • Identifying and correcting issues in patent chain of title in the context of investment in a start-up pharmaceutical company.
  • Advising on benefits and drawbacks of supplemental exam, reissue, and ex parte reexam to strengthen an already-granted patent.
