David J. Shaw represents and advises clients in high-stakes and complex antitrust matters, including government investigations and litigation.

Mr. Shaw has represented clients in government conduct investigations, including both criminal and civil Department of Justice (DOJ) investigations and Federal Trade Commission (FTC) investigations. He has conducted internal investigations. He has also represented clients in a wide variety of antitrust litigation, including complex class action and multi-district litigation. In addition to high stakes representations, Mr. Shaw advises clients on a range of competition issues, including exclusive dealing arrangements and the intersection of competition and environmental concerns.

  • Represent publicly traded company in DOJ Antitrust Division grand jury investigation.
  • Represent trade association in DOJ Antitrust civil investigation.
  • Represent biopharmaceutical company in FTC investigation.
  • In re Wellbutrin XL Antitrust Litigation. Successfully represented Valeant Pharmaceuticals International (formerly Biovail Corporation) in class action litigation consolidated in the Eastern District of Pennsylvania involving allegations of sham litigation. Obtained summary judgment on most claims leading to favorable settlement on remaining claim.
  • Advised trade association on the intersection of antitrust and sustainability initiatives.
  • In re LIBOR-Based Financial Instruments Antitrust Litigation. Representing Citibank in MDL antitrust class actions pending in S.D.N.Y. alleging fixing of libor rates in violation of the antitrust laws, and other federal laws.

Pro Bono

  • Caster v. City of Columbus. Filed amicus brief in the Ohio Supreme Court on behalf of the Innocence Network in support of the Ohio Innocence Project’s access to public records.
