Kavita Pillai represents clients in a wide variety of antitrust matters, from transactions to litigation to compliance. She regularly represents clients in merger reviews by the U.S. Department of Justice and Federal Trade Commission, including responding to Second Requests, and has experience counseling clients on regulatory risk throughout the transaction process. Ms. Pillai also has a broad range of civil litigation experience and frequently counsels clients on litigation risk and antitrust compliance. She also has represented clients in criminal investigations by the Department of Justice.

Ms. Pillai maintains an active pro bono practice.

  • Representing major television broadcasting company in regulatory issues related to its sale of broadcast television stations.
  • Successfully represented Century Link in obtaining clearance from DOJ of $34 billion acquisition of Level 3 Communications.
  • Successfully represented Expedia Inc. in obtaining clearance from the Department of Justice in Expedia’s acquisition of Orbitz Worldwide.
  • Successfully represented Merck & Co. in multidistrict class action litigation alleging violations of the antitrust laws arising out of an alleged reverse-payment settlement of patent litigation with a generic pharmaceutical manufacturer.
  • Represented Eli Lilly & Co. in product liability litigation involving Cymbalta.   
  • Represented Genentech in product liability litigation involving Rituxan.
  • Successfully represented a major corporation in an investigation by the U.S. Department of Justice under the International Traffic in Arms Regulations.
  • Successfully represented Public Service Enterprise Group in insurance coverage litigation arising from damages from Superstorm Sandy.

Pro Bono

  • Successfully represented a death row inmate in a collateral appeal of his conviction and sentencing in Alabama state court. Representation included preparing and presenting evidence during a state court evidentiary hearing and preparing post-hearing briefs, after which the judge granted a new trial on all claims.
