Kavita Pillai represents clients in a wide variety of antitrust matters, with a focus on government investigations. She regularly represents clients in merger reviews by the U.S. Department of Justice and Federal Trade Commission. She has experience counseling clients on regulatory risk throughout the transaction process and responding to Second Requests. Ms. Pillai also represents clients facing civil conduct investigations by federal and state agencies and has a broad range of civil litigation experience. Finally, Ms. Pillai regularly provides antitrust risk assessments of business activities, including of vertical distribution arrangements.

Ms. Pillai maintains an active pro bono practice.

  • General Electric Co. in obtaining clearance from FTC of sale of BioPharma business to Danaher Corporation.
  • Tribune Media Company in obtaining clearance from DOJ of sale to Nexstar Media Group.
  • Cox Enterprises, Inc. in obtaining clearance from DOJ of sale of television, radio, and other assets to Apollo Global Management.
  • Century Link in obtaining clearance from DOJ of $34 billion acquisition of Level 3 Communications.
  • Expedia Inc. in obtaining clearance from the Department of Justice in Expedia’s acquisition of Orbitz Worldwide.
  • Merck & Co. in multidistrict class action litigation alleging violations of the antitrust laws arising out of an alleged reverse-payment settlement of patent litigation with a generic pharmaceutical manufacturer.  

Pro Bono

  • Successfully represented a death row inmate in a collateral appeal of his conviction and sentencing in Alabama state court. Representation included preparing and presenting evidence during a state court evidentiary hearing and preparing post-hearing briefs, after which the judge granted a new trial on all claims.
