Alan Kenny is an associate in the firm's dispute resolution group. He advises corporate, institutional, and high-net-worth clients on dispute avoidance and resolution, focusing on high-value, complex, and multi-jurisdictional disputes. Mr. Kenny has experience representing clients in: mediation; commercial litigation (before the English High Court and Court of Appeal); and international and trade association arbitration (under a variety of rules). He acts for clients in a broad range of industries, with particular experience in the commodities sector.

  • Acted for a foreign exchange trading platform in High Court and Court of Appeal proceedings against investment funds, in a c. $400 million “bet-the-company” dispute concerning allegations of dishonest assistance, unconscionable receipt, deceit, and unlawful means conspiracy.
  • Acted for an international commodities trading house in SCAI arbitration proceedings against a manganese ore producer, in a complex dispute concerning the breakdown of the pricing mechanism in a long-term marketing contract.
  • Represented multinational investment and retail banks, and individual traders, in internal and external investigations relating to potential serious regulatory and competition law breaches across multiple jurisdictions and product areas, and involving the FCA, CMA, EC, DOJ, and SEC.
  • Acted for clients in emergency proceedings relating to security, vessel and container arrest, freezing orders, disclosure orders, Norwich Pharmacal orders, delivery up of passport orders, search orders, committal orders, and anti-suit injunctions.
  • Advised companies in various industries regarding trade sanctions, export controls, and financial regulations/compliance.

  • Advised educational charity on various aspects of its contracts with IT suppliers.
  • Mentored PRIME vacation scheme students from backgrounds under-represented in the legal profession.
