Kevin Collins is a member of the firm’s Intellectual Property and Commercial Litigation Groups and is resident in the firm’s Washington, DC office. Mr. Collins is a seasoned trial lawyer with more than forty-five trials, and has represented clients in a wide variety of patent, trademark, trade secret, and commercial matters in various forums, including United States District Courts throughout the Country. Mr. Collins also has significant appellate experience in both state and federal appellate courts, including having successfully argued Federal Circuit appeals in patent cases.

  • Successfully represented comScore in 2011 in the Eastern District of Virginia in two patent infringement cases involving patents directed to measuring online activities and website traffic. comScore, Inc. v. The Nielsen Company (US), LLC, et al., No. 1:11-cv-290-LMB-TRJ and The Nielsen Company v. comScore, Inc., C.A. No. 2:11-cv-00168-MSD -TEM.
  • Successfully obtained an early summary judgment for MySpace invalidating all claims in four asserted patents directed to web-accessible databases.  MySpace Inc. v. GraphOn Corp. (N.D. Cal. 3:2010-cv-00604).
  • Successfully represented Agere Systems in litigation and arbitration to force Agere’s licensee to honor its obligations under a complex patent license agreement relating to semiconductor fabrication.  Agere Systems Inc. v. Macronix International Co., Case No. 01-CV-7820 (S.D.N.Y.) & AAA Arbitration No. 50-T-133-00079-02.
  • Successful defense of Unilever in the district court and on appeal in the Federal Circuit from patent infringement claims brought by Kao related to Pond’s cosmetic pore strips. Kao Corp. v. Unilever, 441 F.3d 963 (Fed. Cir. 2006), aff’g 334 F. Supp. 2d 527 (D. Del. 2004).
  • Successful defense of a leading vaccine manufacturer against patent infringement claims brought by patentee on patents purporting to claim certain vaccine immunization schedules that minimize risks of autoimmune disorders.
  • Represented a leading sportswear company before the ITC in a 337 proceeding to enforce its patents to bar imports of knock-offs that infringed the company’s patents.  In re Certain Ear Protection Devices, Inv. No. 337-TA-518 (I.T.C.).

Pro Bono

  • Mr. Collins maintains an active pro bono trial practice representing indigent defendants in criminal proceedings in various courts, including the Circuit Courts for Charles, Montgomery, and Prince George’s Counties in Maryland. Mr. Collins has served as lead counsel in thirty-four criminal jury trials.
