WASHINGTON—Brian Nester, a leading patent litigator with extensive experience before the U.S. International Trade Commission and federal district courts throughout the country, has joined Covington’s Patent Litigation Practice as a partner based in the firm’s Washington office.
Brian has been an ITC litigator for 25 years, participated in more than 50 ITC cases, and tried over 20 ITC matters. He has handled matters as lead counsel for top global technology clients, representing leading technology companies including SK hynix, Microsoft, Samsung, Research in Motion, LGE, Nokia, Seagate, Intel, and Tyco. Brian recently led a team successfully defending SK hynix in worldwide litigation spanning the Western District of Texas, Central District of California, International Trade Commission, Munich District Court, and Beijing Intellectual Property Court. He has extensive experience with standard essential patent, antitrust, and breach of contract claims associated with fair, reasonable and non-discriminatory (FRAND) based defenses. Brian’s work in this area covers a broad range of technologies, including semiconductor fabrication, circuit design, cryptography, 4G and 3G telecommunications, Flash, DRAM, memory modules, photolithography, displays, disk drives, magnetic media, solar, and optical communication.

Brian received his law degree from The George Washington University Law School and graduated from Temple University with a B.A. in Biology.
