SEC's Climate Disclosure Rule Ignites Debate, Litigation Over Agency's Authority

Matt Franker’s commentary was included in a National Law Journal article covering the adoption of the Securities and Exchange Commission’s climate disclosure rule, which requires certain large registrants to disclose information on a company’s direct or indirect greenhouse gas emissions.

Matt said most companies have been working on ensuring they have a disclosure process in place or at least developing one in the two years since the SEC’s rule was proposed. “There will certainly be litigation challenging the rule but I would think that even in the short term that you would start to see public companies be more active on this instead of taking a wait and see approach,” he said.
