Moritz Hüsch and Horst Henschen provided their commentary to a Law.com article exploring how lawyers are adjusting to events changing global regulatory law. Moritz discussed the efforts of businesses to navigate new regulatory environments, and Horst analyzed how law firms are adapting to advise their clients as they face the changing regulatory landscape.
“Compliance is becoming more and more expensive and critical,” says Moritz. “It’s really a full-time job to monitor the legal environments, to implement everything, and to manage the risks.”
Horst says he is seeing the “team approach” play out in deal work as the German government has looked to “de-risk” itself from China. “The client’s expectation is to get a seamless service,” Horst says. “And the client doesn’t care whether the rough angle comes from the merger control side or from the FSR (Foreign Subsidies Regulation) side. The client wants to get the deal through in a certain timeframe. And these three prongs are very different in terms of how to approach them. So the client interface is important, and managing the team so that the client doesn’t get the same questions three times.“
