Ben Lenhart's commentary appeared in a Law360 article about the biggest general liability insurance rulings in the first half of 2023.

Ben said that the Third Circuit's ruling in American Home Assurance Co. v. Superior Well Services, was "wrongfully decided" and set a "dangerous precedent," explaining that the appeals court created a new test for fortuity.

"It's classically why you buy insurance," Ben said, adding that the Third Circuit's rationale cuts out a large chunk of coverage.
