Skilled in the Art With Scott Graham: The Winds Are Shifting at the PTAB + A New Judge and a New Complaint Get a New Result Against Amazon

Scott Weidenfeller, a former Vice Chief Administrative Patent Judge at the PTAB, spoke with Law.com about USPTO Director Kathi Vidal's first-of-its-kind order instructing the PTAB to reconsider a preliminary order in an America Invents Act proceeding.

“The winds are blowing in favor of petitioners, more so than they were under Director Iancu,” Scott observed.

Scott added that Vidal is taking “measured approaches. She’s not undoing everything that Director Iancu put in place. But within those boundaries she’s moving toward the other end of the spectrum.”
