FTC Chairwoman Sees Antitrust Bill as Threat to Authority

Co-chair of the Antitrust and Competition Law Practice Group Deborah Garza’s testimony before the Senate subcommittee on Antitrust, Competition Policy and Consumer Rights is quoted in this National Law Journal article discussing antitrust authority in relation to the SMARTER Act. Garza has testified three separate times in support of this Act, born out of the 2007 report by the congressionally-established bipartisan Antitrust Modernization Commission (AMC), arguing for the harmonization of the U.S. Justice Department's and FTC's overlapping antitrust authority. “Although it's been eight years since the AMC made those recommendations, I have never lost faith that the good-government vision of the AMC recommendations would prevail," says Garza. She further notes that five of the six Democrats appointed to the antitrust commission supported the three recommendations in the Smarter Act.
