Federal Trade Commission Practice in Light of Chevron's Uncertain Fate

The U.S. Supreme Court will issue decisions in Loper Bright Enterprises, Inc., et al., v. Raimondo, 45 F.4th359 (D.C. Cir. 2022), cert. granted in part, 143 S. Ct. 2429 (2023) and Relentless, Inc. v. United States Dep't of Commerce, 62 F.4th 621 (1st Cir. 2023), cert. granted in part, 144 S. Ct. 325 (2023) before the end of June 2024. Those decisions may overturn or limit the scope of the deference that courts give agency interpretations of statutes under Chevron, U.S.A., Inc. v. Natural Res. Def. Council, Inc., 467 U.S. 837 (1984).
