CFTC and Foreign Corruption - A New Enforcement Calculus

Date: Wednesday, July 24, 2019 12:00 PM - 1:00 PM

Venue: Webinar

Please join Laura Brookover, Ben Haley, and Jennifer Saperstein for a webinar presentation on the new foreign corruption focus of the Commodity Futures Trading Commission (CFTC). The CFTC recently announced that it is investigating foreign bribery under the Commodity Exchange Act, paving the way for foreign corruption charges brought under a statute other than the FCPA and by an agency other than the Department of Justice (DOJ) or the Securities and Exchange Commission. The CFTC is reportedly coordinating with DOJ on this initiative, which expands the parallel efforts already underway between the agencies.

The CFTC’s new initiative is most relevant to international companies engaged in commodity manufacturing or trading, and to U.S. companies that are registered with the CFTC.

The presentation will cover:

  • The legal framework for CFTC actions enforcing against foreign corruption.

  • Jurisdictional differences between the FCPA and CEA.

  • Implications of the CFTC’s and DOJ’s enhanced coordination.

  • Questions that companies should ask about their internal compliance and controls.

Approval for NY, CA, and VA CLE credit is pending.
