Environmental Litigation

• Representing coalition of advanced energy interests and power companies as respondent-intervenors in support of EPA in litigation challenging EPA’s revised GHG standards for light-duty vehicles for model years 2023-2026, Texas v. EPA, No. 22-1031 (D.C. Cir.) and EPA’s reinstatement of a waiver of federal preemption allowing California to enforce its own greenhouse gas and zero emission vehicle standards for light-duty vehicles, Ohio v. EPA, No. 22-1081 (D.C. Cir.).
• Representing major electric utilities challenging EPA’s decision that regulation of hazardous air pollutant emissions from coal- and oil-fired power plants is not appropriate and necessary and defending against challenges to EPA’s Mercury and Air Toxics Standards (D.C. Circuit Case Nos. 20-1160 and 20-1221).
• Representing former Administrators of the Environmental Protection Agency as amici curia in support of respondent EPA’s authority to protect certain wetlands under the Clean Water Act, Sackett v. EPA, No 21-454 (2022)

Permitting & Environmental Reviews

• Advising major government contractor on National Environmental Policy Act (NEPA) issues implicated by a government agency’s procurement of replacement vehicles for its delivery fleet, including a substantial amount of electric vehicles.
• Advising major refiner on regulatory and permitting issues implicated by a county’s certification of an environmental impact report under the California Environmental Quality Act (CEQA) to convert a circa 1913 petroleum refinery to production of renewable diesel from feedstock such as tallow, used cooking oil, distillers corn oil and soybean oil.
• Provided legal and policy counsel to national environmental NGO on potential revisions to national permitting and environmental review procedures.

ESG & Policy Advice

• Providing financial institutions with regulatory and policy advice implicated by ESG products and the use of ESG criteria in financial decision-making.
• Provided ESG and environmental policy advice to a major financial institution on the potential acquisition of a multi-national chemicals company.
