Nick Francescon is a member of the firm’s entertainment, sports and media practice in China, which advises media companies, studios, producers, talent, sports leagues and associations and financial institutions and investment funds on their activities in the PRC. As one of the only entertainment lawyers on the ground in China with substantial Hollywood and international experience, Mr. Francescon is uniquely suited to advise Chinese entertainment and media companies on their outbound projects, as well as uniquely positioned to understand the perspective of international entertainment and media companies as they approach the Chinese market.

  • Currently advises major Hollywood studios and production companies in connection with Chinese-foreign co-productions.
  • Represented the legal and business affairs interests of a U.S. production company and its related foreign development fund in connection with development deals, guild interactions and litigation risks; advised its U.S. and U.K. company executives on a development, production and distribution slate of 25+ feature film projects.
  • Supervised motion picture production legal and delivery for independent U.S. and international feature films such as “Bad Words” -- Jason Bateman’s directorial debut, “Jimi: All Is By My Side” -- a Jimi Hendrix biopic starring André Benjamin, “Home Sweet Hell,” “Hell Baby,” and “Bone in the Throat.”
  • Negotiated and closed two concurrent film sales at the 2013 Toronto International Film Festival, one of which included a multi-million dollar minimum guarantee by a major studio.
  • Represented the legal and business affairs components of a U.S., U.K. and Irish co-production that included cross-border financing pieces, tax credits, international guild obligations and complex chain-of-title considerations relating to original and licensed musical compositions and masters.
  • Resolved IATSE-backed efforts in 2014 to impede a local film production, resulting in the restoration of filming within days.
  • Assessed the digital distribution and licensing deals of mini-major’s extensive library and prepared rights analyses regarding scope of distribution rights.

  • Mr. Francescon joined Covington after serving a dual role as Of Counsel at a boutique Beverly Hills entertainment law firm (2012-2015) and as Counsel, Business Affairs at Movie Package Company LLC/Derby Street Films Ltd. (2011-2015).
  • During his J.D. and LL.M. programs, Mr. Francescon was a judicial extern for the Honorable Phillip S. Figa of the United States District Court for the District of Colorado (2007) and a legal and business affairs extern at Lions Gate Entertainment (2011).
