Covington On-Demand Briefing: The EU Proposed Regulation on Sustainable Batteries

The European Parliament and Council are currently considering for adoption a Commission Proposal for a Regulation on Sustainable Batteries that will impose both sustainability and safety requirements on batteries marketed in the EU/EEA. The Proposed Regulation is a new generation of EU environmental legislation and is intended to achieve the EU’s ambitious climate change and circular economy goals. It imposes innovative specific requirements (e.g., carbon footprint, recycled content, supply due diligence) on electric vehicle batteries and industrial batteries, as well as environmental design, chemical composition, safety, labelling, waste take back, electronic exchange of information and conformity assessment procedures on all batteries.

This on-demand briefing gives an overview of the Proposed Regulation’s innovative requirements for batteries, and outlines the different steps and actors of the legislative procedure that the proposal will follow, and the main issues that are likely to be discussed, before the Regulation is adopted.
