Mark Chen practices in Covington’s litigation group. He specializes in complex commercial matters, including transactional disputes, class action and business torts, and disputes relating to intellectual property. Mr. Chen has litigated commercial and intellectual property cases in federal and state court, and also has extensive experience with government investigations.

  • Serve as national counsel for the United States Olympic Committee in a series of cases in which former Olympic athletes contend that the USOC should be held liable for abuse by former USA Gymnastics physician, Dr. Larry Nassar.
  • Representing hospitals in litigation regarding reimbursement from health insurers for emergency medical services provided to out-of-network health and insurance plan members.
  • Represented Sony Music Entertainment in Quincy Jones’ lawsuit against Michael Jackson’s Estate. Successfully removed Sony as a liability defendant in the case, and eliminated exposure to damages.
  • Represented Fox News Networks in Fox News Network LLC v. Charter Communications Holding Co. LLC et al., a breach of contract action alleging that Charter applied incorrect carriage rates for all systems following its acquisition of Time Warner Cable.
  • Represented a prime contractor in a False Claims Act case regarding a multibillion-dollar government contract for nuclear waste remediation. Obtained favorable settlement following discovery, summary judgment, and Daubert motions.
  • Advise video game companies on issues relating to micro-transactions and gambling.
  • Represented international banking client in parallel investigations in the U.S., UK, Hong Kong, Japan, and Korea concerning the global foreign exchange markets.

Pro Bono

  • Lead counsel in representing two individuals in challenging Ventura County’s implementation of a “gang injunction,” which allowed police officers to unilaterally subject individuals to onerous, life-long restrictions (such as curfews) based on a suspicion that the individual is affiliated with a gang. Following discovery and motion practice, the County dismissed both individuals from the injunction and subsequently suspended the injunction as a whole to re-evaluate its implementation.
  • Representation of refugees in defensive asylum proceedings.
  • Representation of prisoners in a federal class action litigation relating to unconstitutional prison conditions.
  • Representation of a defendant in criminal proceedings in New York.
  • Representation of a Mandarin-speaking client in an adversary proceeding in bankruptcy court.
